S.A. Pruem Winery’s General Business Conditions
The Rules and Regulations regarding Purchase of Wines

Please note:

Without exception, wines purchased by Email, Post, Telephone or Fax can only be delivered within the Federal Republic of Germany.

Regarding our Offer:

Any and all offers contained herein are subject to change at any time.

Our prices reflect the current valid Mehrwertsteuer/Value Added Tax of 19% at the Winery. Sparkling wine prices also include the Sekt or Sparkling Wine tax as well.

Delivery:

Delivery can be made ONLY within the Federal republic of Germany.

Delivery will be made free of charge only within the land-mass of the Federal Republic of Germany for quantities of 36 bottles or more. There is no free-charge delivery to off-shore islands.

Orders containing fewer than 36 bottles will be charged for handling and shipping to the Purchaser’s office or domicile. Bottles will be packed in units of 6-, 12-, or 18-bottles for a uniform charge of EUR 8.—

Advance Payment:

New customers are required to pay for merchandise in advance. We will confirm your order and require payment via PayPal.

We require that first-time customers pay their invoices per bank transfer directly to our account.

In the event that a wine is sold out, we reserve the right of sending a partial delivery or a substitute delivery, i.e. – a different vintage. The customer will, however, be advised of this prior to shipment. Glass, (bottles) and packing materials from our deliveries will be accepted for re-cycling or disposal by us at the Winery.

Mode of Payment:

Order invoices are due within eight (8) days of the date of invoice without discount. Representatives are not entitled to commissions.

We accept the following credit cards:

American Express, VISA, MasterCard/EuroCard, and the EC Direct Withdrawal Bank Card and finally via PayPal.

Replacement of Breakage:

The Winery’s Cartonage has been approved by transportation companies and the German Postal Service as being suitable for the transportation of our wares. Therefore, in case of breakage or damage, the merchandise will be replaced.

Should damage occur, it is essential that the consignee immediately inform the party delivering the goods of any damage at the time of delivery. The extent of damage must be ascertained and confirmed, and we should likewise be immediately appraised of the situation.

Reclamation:

Reclamation of any sort must be made within 14 days of receiving the merchandise in order to make them valid. The presence of wine-crystal precipitates in the wine are entirely natural and have no influence on the quality of the wine. Therefore, they are not a ground for a reclamation.

A replacement delivery can only first take place following the return of substandard wares. There are no grounds for reclamation when the substandard condition of the merchandise is a result of the consignee’s incorrect handling or storage which has led to the lessening of quality. Wine must be stored in a cool, dark place.

Right of Return:

The consignee has the right to return the merchandise without cause within two weeks of delivery as his own expense. The customer is responsible for any deterioration of the product in the meanwhile if such is found to exist..

Proprietary Right:

All merchandise including packaging and packing is our exclusive property until the merchandise has been paid for in full. The customer is not entitled to resell or in any way tamper with the merchandise.

Legal Jurisdiction:

Bernkastel-Kues, Wehlen/Mosel Community is the official business transaction site. The District Court of Bernkastel –Kues is the jurisdiction for all legal matters. All contracts and agreements will be executed in the German language. All legal proceedings will be conducted according to the Laws of the Federal Republic of Germany.
